Privacy policy

This notice explains how personal data is handled when you visit Captured.Observer or contact its operator. The site is a personal collection of smartphone images and stories.

2. Visiting the website

The website is hosted and delivered through Cloudflare Workers and Cloudflare’s network. To deliver pages and protect the service, Cloudflare processes connection and request information, including IP addresses, requested URLs, timestamps, browser or device information transmitted with requests, response information and security events.

The purposes are delivery, availability, troubleshooting and protection against abuse. Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, United States, provides these services. See Cloudflare’s Privacy Policy and its Data Processing Addendum for information about its processing and safeguards. This site does not operate a separate visitor database.

3. Cookies, analytics and embedded content

The website’s own code sets no cookies and includes no advertising, tracking pixels or client-side analytics. It has no accounts, contact forms, newsletters or embedded social-media players. Images and styles are served from this website; fonts use your device’s installed typefaces. Cloudflare can process technical request data and use security mechanisms when protecting the service. This is separate from advertising or behavioural profiling by this website.

When you close the privacy notice, sessionStorage stores a single preference (captured-observer-notice-v1) in your browser tab so the notice stays closed as you browse. It contains no personal identifier, is not sent to the server and lasts for the tab’s session. Closing the notice does not grant consent to tracking. If browser storage is unavailable, the notice can still be closed on the current page.

4. Email and telephone contact

If you contact me, I process the contact details, message contents, attachments and communication metadata you provide to answer your enquiry and handle any follow-up. Please avoid sending sensitive information that is not needed for your enquiry.

The direct contact mailbox hello@marioobst.com uses Apple iCloud Mail. Apple processes messages and associated data to provide the email service. Details are available in Apple’s Privacy Policy and iCloud & Privacy. Telephone communications also involve the telecommunications providers used by each party. Contact data is not used for unsolicited marketing.

5. Applicable law and purposes

Personal data is handled in accordance with applicable data protection law, including the Swiss Federal Act on Data Protection where applicable. To the extent the EU General Data Protection Regulation applies, delivering and securing this website and answering general enquiries are based on legitimate interests under Article 6(1)(f): maintaining an accessible, secure personal website and responding to correspondence. Processing necessary for a requested contract or steps before a contract is based on Article 6(1)(b), and processing required by law on Article 6(1)(c).

6. Recipients and international processing

Data is accessible to the operator and the service providers needed for hosting, security and communication. It may also be disclosed where legally required or necessary to establish, exercise or defend legal claims. Personal data is not sold.

Cloudflare and Apple operate internationally; processing can take place outside Switzerland, including in the United States and the European Economic Area. Their published privacy and contractual documents describe processing locations and transfer arrangements. Cloudflare’s Data Processing Addendum provides mechanisms for restricted transfers, including standard contractual clauses and applicable data-protection framework arrangements. Apple describes its international transfer safeguards in its Privacy Policy. You can contact me for information about the safeguards relevant to your data.

7. Retention

Correspondence is retained for as long as needed to answer the enquiry, complete related follow-up and meet applicable legal retention or claims requirements. It is then deleted when no further reason for retention remains. Technical information held by Cloudflare and email data held by Apple is also subject to their service-specific retention, security and backup processes; there is no single retention period covering all such records. Requests about particular records can be sent to the contact addresses above.

8. Your rights

Depending on the law applicable to your request, you can ask for information about and access to your personal data, correction, deletion, restriction of processing or a portable copy. You can object to processing based on legitimate interests and withdraw consent where processing relies on consent. Legal exceptions can limit these rights. I may request proportionate information to verify your identity before responding.

You can contact the Swiss Federal Data Protection and Information Commissioner (FDPIC). If the GDPR applies, you also have the right to lodge a complaint with the competent supervisory authority, particularly in the country of your habitual residence, workplace or the alleged infringement.

9. External links and public content

Following a link to Pexels, marioobst.com or another external website connects you to that provider, whose privacy practices then apply. Profile references in this website’s structured data are ordinary URLs, not social tracking plugins. Published pages and images are publicly accessible and can be indexed by search engines and other crawlers.

10. Security and changes

The website uses HTTPS. No internet transmission or storage system can be guaranteed completely secure. This notice will be updated when the site’s services or processing practices change.
